Chapter 13Legal & Rights

What should I check before signing an employment contract?

Notice period, probation terms, non-compete and IP clauses, overtime and on-call expectations, bonus conditions, and whether the job description is attached. Anything promised verbally should appear in writing before you sign.

Follow-up questions

Are non-compete clauses enforceable?

It varies enormously. Several US states void them entirely and UK courts only uphold narrow, short, geographically limited ones. Assume they're enforceable until advised otherwise.

Who owns work I create on the job?

Usually the employer, and many contracts extend that to inventions made using company time or equipment. Side-project carve-outs must be written in.

Can an employer change my contract?

Material changes normally need your consent. Unilateral changes can amount to breach, though some contracts contain limited variation clauses.

Should I get a contract reviewed by a lawyer?

For senior roles, equity compensation, or aggressive restrictive covenants, a one-hour review is cheap relative to the risk.
